Guest Terms & Conditions
Last Updated: July 4, 2026These Guest Terms & Conditions govern your booking and participation in Libertad Whale Shark™ activities.
1. Booking Confirmation
A reservation is confirmed only after full payment is received and an official booking confirmation is issued. Guests must provide accurate names, contact details, and travel dates.
2. Identity Verification
Guests may be required to present valid identification at check-in. Special discounts require supporting documents.
3. Arrival & Check-In
Guests should arrive at least 15 minutes before their scheduled pickup or activity. Late arrivals may be accommodated only if seats and operations allow.
4. No-Show Policy
Guests who fail to arrive without notice are treated as No-Show. No-Show bookings are non-refundable and not eligible for rebooking.
5. Cancellation & Refund Policy
Guests who cancel at least 24 hours before the activity may receive a full refund. Late cancellations, no-shows, voluntary withdrawal, or denied participation are non-refundable.
6. Rebooking Policy
Guests may request one complimentary rebooking before the scheduled activity, subject to availability, weather, and operational advisories.
7. Ticket Transfer Policy
Tickets are transferable before check-in. The replacement guest assumes the rights and obligations of the booking.
8. Weather, Sea Conditions & Force Majeure
Activities may be delayed, modified, rescheduled, or cancelled for safety, weather, sea conditions, government advisories, mechanical issues, or force majeure.
9. Whale Shark Sighting Policy
Whale sharks are wild animals and sightings are not guaranteed. Absence of sightings does not automatically entitle guests to a refund if the activity proceeds safely.
10. Environmental Conservation
Guests must follow all environmental rules and must not touch, ride, feed, chase, block, flash-photograph, litter, or harass marine wildlife.
11. Health & Fitness
Guests participate voluntarily and should consult a physician for serious medical conditions, pregnancy, recent surgery, or mobility limitations.
12. Swimming Ability & Safety Equipment
Basic swimming ability is recommended but not mandatory. Life jackets and required safety equipment must be worn as instructed.
13. Guest Conduct
Guests must behave respectfully. Unsafe, intoxicated, aggressive, disruptive, or non-compliant behavior may result in removal without refund.
14. Assumption of Risk & Limitation of Liability
Marine activities involve inherent risks. Guests voluntarily assume ordinary risks except where liability cannot be excluded by law.
15. Personal Belongings
Guests are responsible for personal belongings and are encouraged to secure valuables and use waterproof bags.
16. Photography & Media Consent
Photos and videos may be taken for documentation, promotional, marketing, educational, and social media purposes unless a guest notifies staff before the activity.
17. Child Policy
Children must be supervised by a responsible adult. Children below seven may be limited to boat-viewing only depending on operations and safety conditions.
18. Data Privacy
Booking personal information is processed according to the Data Privacy Act of 2012 for verification, logistics, safety, and legal compliance.
19. Compliance with Laws & Government Regulations
Guests must comply with applicable Philippine laws, ordinances, sanctuary rules, environmental regulations, and safety protocols.
20. Severability
If any provision is invalid or unenforceable, the remaining provisions continue in effect.
21. Governing Law & Jurisdiction
These Terms are governed by Philippine law and disputes are subject to the proper courts of Malay, Aklan.
22. Amendments
Libertad Whale Shark™ may amend these Terms at any time. The latest published version governs bookings and activities.
